NO PURCHASE NECESSARY TO ENTER. Entries for this contest (the “BERNINA Like it Contest”) will be accepted during the period beginning at 12:01 a.m. ET on April 23, 2012 and ending at 11:59 p.m. ET on April 30, 2012 (the “Submission Period”). All entries must be received during the Submission Period. The Contest is open to legal residents of the United States and Canada (except Quebec), who are at least 18 years old. Contest void in Quebec, and anywhere else where prohibited.

HOW TO ENTER: To participate in the contest, visit the Threads Magazine Facebook Page (www.facebook.com/ThreadsMagazine) during the Submission Period, and follow the directions to the Bernina Facebook page (www.facebook.com/BerninaUSA i.e. the “WebSite”) to submit an answer to our editor’s question on the Bernina Facebook wall. There is no limit to the number of entries. At the Website, participants will be required to “like” the Bernina page to be able to post to the Bernina wall. All entries become the property of the Sponsors (hereinafter defined) and will not be returned.

Submission Requirements: Each answer submission that is entered into the Contest must meet ALL of the “Submission Requirements” set forth below (any Submission that, in Sponsor’s good faith judgment, violates the following criteria will be disqualified): 

The Submission must be the submitting entrant’s original unmodified, previously unpublished work; The Submission must not include images or text that is obscene, pornographic, libelous, illegal, discriminative or otherwise objectionable; and The Submission must not include any corporate logos or any material that may infringe on the copyrights or intellectual property of any third parties.

By entering into this Contest, each entrant represents and warrants that (i) his or her Submission is entrant’s own original, previously unpublished work; (ii) The submission, the response, is not subject to copyright.); (iii) that such Submission does not violate the rights of any third party or infringe or violate any law, and as of the date of the Submission, is not the subject of any actual or threatened litigation or claim; and (iv) the Submission does not and will not violate any applicable laws, and is not and will not be defamatory, libelous, pornographic or obscene. Note: Sponsor reserves the right, in its sole discretion, to disqualify any Submission in the Contest if Sponsor views the Submission as potentially infringing or otherwise a violation or potential violation of a third party’s rights or seek to secure permission for Sponsor’s benefit and allow the applicable Submission to remain in Contest. Sponsor reserves the right to disqualify any Submission in the Contest if it deems the Submission to be lacking in taste, quality, or to be otherwise objectionable.

Submissions must be received by the end of the Submission Period. The Website’s database clock will be the official timekeeper for the Contest. Submissions become the exclusive property of Sponsor and will not be returned or acknowledged. Proof of submission is not considered proof of delivery or receipt of such Submission to Sponsor. Sponsor shall have no liability for any Submission that is lost, intercepted or not received by Sponsor, for any reason.

All Participants must comply with these Official Rules. The Website is governed by the Taunton Press Privacy Policy, which is available at the Website. Sponsors are not responsible for unavailable networks, failed server or other connections, miscommunications, interrupted, misrouted or scrambled transmissions or other errors or problems of any kind whether mechanical, human, electronic or otherwise. The Sponsors assume no responsibility for lost, stolen, delayed, damaged or misdirected entries or for any failure of the Website during the contest period, for any problems or technical malfunction of any telephone network or lines, computer on-line systems, access providers, computer equipment, software, failure of any e-mail entry to be received by Sponsors due to technical problems or traffic congestion on the Internet or at any website, of any combination thereof including any injury or damage to a participant’s or any other person’s computer related to or resulting from playing or downloading any material related to the contest. Sponsors reserve the right, in their sole discretion, to cancel or suspend the Contest should a virus, bug or other cause beyond the reasonable control of the Sponsors corrupt the security or proper administration of the contest. Any attempt to deliberately damage any website or to undermine the legitimate operation of the Contest may be a violation of criminal and civil laws, and should such an attempt be made, Sponsors reserve the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution. Entries are subject to verification and will be declared invalid if they are illegible, forged, falsified, altered or tampered with in any way. The Contest Rules are subject to the interpretation of the Sponsors, and all decisions related thereto are final.

NO PRIZE TRANSFER OR SUBSTITUTION. No prize or any portion thereof is transferable or redeemable for cash.  Any portion of the prize that is not used is forfeited.  No substitutions for prize except by Sponsor, in which case a prize of equal or greater value will be substituted.

TAXES. Except where prohibited, all federal, state, provincial, local or other tax liabilities, including but not limited to luxury, sales, use, income, VAT, GST, and PST tax, if any, are the sole responsibility of the winner.  In the event of a Canadian winner, Sponsor will deduct any applicable withholding taxes imposed by the U.S. and applicable state governments from value of prize award thd the prize award value will be adjusted accordingly.

TERMS/CONDITIONS: Sponsors shall not be responsible for any unsuccessful attempts to notify the winners. Employees, officers, and contractors (including immediate family members and members of the same household) of Sponsors, affiliated companies, subsidiaries, distributors, dealers, retailers, vendors of Sponsors, and all other entities associated with this promotion, are not eligible.

Each participant agrees to release and hold the Sponsors, their employees, officers, directors, shareholders, agents, representatives, and their subsidiaries, parent companies, or other affiliated companies harmless from any and all damages, losses, claims and/or liabilities arising out of his or her participation in the Contest or resulting from accepting or claiming any prize awarded hereunder. Unless indicated otherwise by checking the opt-out box on the Website, participants acknowledge and agree that Sponsors may use personal information collected through the Contest from time to time to contact participants for advertising and promotional purposes.

Notwithstanding the foregoing paragraph, participation in the Contest constitutes permission (except where prohibited by law) for the Sponsors to use any winner’s name, likeness, biographical information, photographs and any statements or remarks made about winning or participating in the Contest for advertising and promotional purposes (in any medium) without additional compensation.

WINNING: Judging Criteria. Among all qualified entries received, the judging organization (the “ThreadsMagazine editors”) shall select one prize winner on or about April 30, 2012. The Winners will be announced on or about May 1, 2012. Odds of winning will depend upon the total number of eligible entries received.  All decisions by the Judges shall be final and binding.

The winners will be selected from all eligible Submissions based on best overall answer as selected by our editors. 

There will be one Prize winner. No more than the advertised number of prizes will be awarded.

Winners will be notified within 14 days of selection by telephone, mail or email.

CLAIMING PRIZES: The winner must sign and return an Affidavit of Eligibility and Liability/Publicity Release (or in Canada a Declaration of Compliance) within thirty (30) days of notification, or his or her prize may be forfeited. Publicity Release not required where prohibited by law. Prizes will be delivered to each winner’s residence within thirty (30) days of receiving the Affidavit of Eligibility and Liability/Publicity Release. Winners will also be required to provide proof of age.
